These terms govern your use of the website fernpoint.help ("the Site") and set out the general basis on which Fernpoint Digital Sdn Bhd (Company Reg. No. 202301042817 (1528466-M)) ("Fernpoint", "we") provides services. By using the Site you accept these terms.

1. About the Site

The Site presents our services, past work and articles. Content is provided for general information; it is not professional advice for any specific situation, and figures quoted from past projects do not guarantee equivalent results for yours.

2. Use of the Site

You agree not to misuse the Site — including attempting unauthorised access, probing for vulnerabilities, scraping content at scale, submitting malicious code through forms, or impersonating another person in correspondence. We may restrict access where misuse is detected.

3. Intellectual property

All content on the Site — text, design, graphics, code and imagery — belongs to Fernpoint or its licensors. You may view, bookmark and share links freely, and quote brief excerpts with attribution. Republishing substantial portions, or using our materials to market a competing service, requires our written permission.

4. Service engagements

Client work is performed under a separate written proposal and services agreement signed by both parties. Each proposal states scope, deliverables, fees, payment schedule and timelines. If anything in these website terms conflicts with a signed agreement, the signed agreement prevails.

5. Quotations and enquiries

Responses to enquiries, indicative pricing and audit findings shared before a signed agreement are given in good faith but are not binding offers. Quotations remain open for 30 days unless stated otherwise.

6. Client responsibilities

Project outcomes depend on timely input. Clients agree to provide content, approvals and access reasonably requested, and to ensure materials supplied to us do not infringe third-party rights. Delays in client input may extend timelines without liability on our part.

7. Warranties and liability

The Site is provided "as is". We work carefully but do not warrant the Site will be uninterrupted or error-free. To the fullest extent permitted by Malaysian law, Fernpoint is not liable for indirect or consequential loss arising from use of the Site, and our aggregate liability connected with the Site shall not exceed RM1,000. Nothing in these terms excludes liability that cannot lawfully be excluded.

8. Third-party links

Links to external sites are provided for convenience. We do not control and are not responsible for their content or practices.

9. Privacy

Personal data submitted through the Site is handled as described in our Privacy Policy and Cookie Policy.

10. Changes

We may update these terms from time to time. The revision date above reflects the current version; continued use of the Site after changes constitutes acceptance.

11. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over disputes arising from them.
